The ninth circuit court has upheld a prohibition on deploying national guard in Portland, Oregon, following a latest court ruling.

Judicial Panel Concurs to Rehear Case

The ninth circuit court of appeals decided on this week that it would rehear the legal dispute concerning the president’s authority with an larger panel of 11 judges. The judicial body also overturned a previous decision from a smaller judicial group that had supported the administration.

Legal Saga Over Military Presence

This legal directive represents the most recent turn in a long-running court case over whether the administration has the legal right and valid reason to deploy state military units in the city. Approximately two hundred troops have been in uncertainty since late September when the deployment effort was initiated in response to months of protests.

Conflicting Arguments

The administration has argued that federal officials at the immigration center in south Portland were under attack, while city and state officials assert that local officers have control of the circumstances.

In defiance of descriptions of the city as “war ravaged”, locals have been posting videos of lush hiking trails and a vibrant culinary culture, and organizing activities such as an protest bicycle event against the increased military presence.

Recent Legal Actions

The Tuesday ruling came after a federal judge in Portland issued two legal injunctions this period – one blocking the federal control of the Oregon national guard, and another prohibiting the use of any military personnel in the state, after attempts to circumvent the first order by mobilizing out-of-state forces.

On the previous day, the ninth circuit panel had put the first ruling on hold – permitting command of 200 Oregon national guard – but the second ruling stayed effective, preventing the physical sending of the forces.

The Tuesday decision means the matter will be heard by the full court – with all decisions under review simultaneously – by a group of 11 judges.

“This decision shows that the truth matters and that the courts are working to ensure government responsibility. The constitution limits the president’s power, and Oregon’s communities cannot be treated as a training ground for expansive government power,” stated the legal representative in a official comment.

“The judicial body is sending a clear message: the president cannot send the military into US cities unnecessarily. We will continue protecting Oregon’s laws, principles, and autonomy as this case progresses and our legal battle continues in the judicial system.”
